Agreement to Terms

Welcome to KaeMe! These Terms of Service ("Terms") govern your use of the KaeMe mobile application (the "App") operated by KaeMe ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

KaeMe is a productivity application that helps you:

• Create and manage personal tasks and reminders
• Set daily priorities with Focus3
• Track productivity and completion metrics
• Use voice input for hands-free task creation
• Sync data across devices
• Receive customizable notifications and reminders

Account Registration

Creating an Account

• You may use some features without an account
• Full functionality requires account registration
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials

Account Security

• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• We are not liable for losses due to unauthorized account use

Subscription and Payments

Free and Premium Tiers

• Basic features are available for free
• Premium features require a paid subscription
• Subscription details and pricing are displayed in the App

Billing

• Subscriptions are billed through the Google Play Store or Apple App Store
• Payment is charged to your app store account upon confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period

Cancellation and Refunds

• Cancel anytime through your app store account settings
• No refunds for partial subscription periods
• Refund requests are subject to app store policies

Price Changes

• We reserve the right to change subscription prices
• Price changes will be communicated in advance
• Continued use after a price change constitutes acceptance

Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App or servers
• Upload malicious code or content
• Impersonate another person or entity
• Use the App to harass, abuse, or harm others
• Violate any applicable laws or regulations
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use automated systems to access the App without permission

Intellectual Property

Our Rights

• The App and its original content, features, and functionality are owned by KaeMe
• The App is protected by copyright, trademark, and other intellectual property laws
• Our trademarks and trade dress may not be used without prior written permission

Your Content

• You retain ownership of the tasks and content you create
• By using the App, you grant us a license to store, process, and display your content to provide the service
• You represent that you have the right to submit any content you provide

Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the practices described in the Privacy Policy.

Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY

No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Results from using the App will meet your requirements

Task Reminders

While we strive to deliver notifications reliably, we cannot guarantee delivery of all reminders due to device settings, network conditions, or other factors beyond our control. You should not rely solely on the App for critical reminders.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $50, WHICHEVER IS GREATER

These limitations apply regardless of the legal theory and even if we were advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless KaeMe and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or data

Termination

By You

• You may stop using the App at any time
• You may delete your account through the App settings

By Us

We may terminate or suspend your account and access immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the App

Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Provisions that should survive termination will remain in effect (including Disclaimers, Limitation of Liability, and Indemnification)

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending a notification for material changes

Continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@kaeme.app.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except for claims that qualify for small claims court.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class actions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KaeMe regarding the App and supersede any prior agreements.
